First pray the repairs to your car don't cost 75% of the value of your car. If it does, it will be totaled. This happened to a friend. Hit from behind, fender and trunk damage. Repairs exceeded blue book value, so insurance company totaled the car. Car was in excellent shape. Now she is without the car that was paid for and has to buy a new one. I didn't know about this law until I heard about it from her. Sounds like the auto sales industry had a hand in this law.

State Farm, meanwhile, never penalized drivers for not-at-fault accidents

Which is the case with my company and many others I've worked with.

Do you mind listing the companies?
I'm blogging on my website soon, but cannot find any info.

If they're following you to begin with, yes. If you abruptly changed lanes in front of them and slammed on the brakes I don't think the same rules apply.

Even with a signal engaged you can still be cited as my daughter was. She signaled and abruptly cut over (like 99% of drivers do) and was told by the police that a signal does remove responsibility from her for the accident. A signal is to let other drivers know your intentions. After signaling you are to wait until you can safely merge with traffic.
