It was the offseason if I remember right. I'm wondering if they do suspend him for violating company policy does he have a legal case to get that suspension thrown out. For example a company can't legally put in place a policy forbidding you to take a prescription if it doesn't effect you on the job. In this case during the offseason it would not effect him on the job.

That's not really how it works in the United States.

when it comes to drugs, wanna bet?

quote:

Just because it's illegal federally doesn't mean that a state or local cop is going to arrest you for it

no one is talking about arresting anyone... we are talking only about the legality of it... all the states in the US could legalize it, but if the FEDERAL law is not changed, and it's not removed from the scheduled drug list, it's still ILLEGAL per the federal law... sure, you may not get arrested for it, but it's still illegal, and could carry penalty for violation of said law...

quote:

We have to get away from this idea in this country that the levels of government in the US exist in a hierarchy. That was never the original intent. The original intent was more like what you see with the European Union. Notice the name of this country isn't, the 'People's Republic of China' or 'Germany' or 'Japan' or the 'United Kingdom' . It's, the 'United States of' the continent of 'America'. The States having primacy and being 'United' for common defense.

um, that's nice, but nothing in this diatribe negates what was stated... when it comes to drug laws, the federal law, until changed, will still be in violation, even if the state law makes it legal... sorry, but that's just, you know, the facts...

quote:

There was a time when Americans were loyal to their States

oh yeah, i remember... you want to go back to those times? you know, the whole "state's rights" times??

quote:

That the mental shift took place with the gradual and expected growth and power grab by the federal government is why States rights have been severely weakened.

don't know about you, but i'm loyal to my COUNTRY, not my state... i love Louisiana, despite how fricked up things may be here from corruption and greed, but it's home and always will be... i will always be a proud Louisianian, but it doesn't and never will supersede my devotion to my country....

Regular jobs ban use of legal substances right before or during work hours.

The NFL isn't a regular job. The substances on the banned list can NEVER be taken (without a legit doctor's consent under special circumstances). Doesn't matter if it was the offseason or not.

That said, he never was proven to have USED the marijuana in any way, so I think at best they'd ding him for two games for conduct policy violation at most, but I doubt even that.
