If you record it without listing the songwriters then you've stolen it.

With comedy there are no writing credits, it's implied that you wrote the material or paid someone to write it.

My point was that stolen jokes go back forever, including Abbott and Costello's most famous bit being something that they'd seen someone else do in Vaudeville.

Benny Hill would travel the world going to obscure clubs, theaters, and circuses, looking for jokes and physical comedy bits to bring back for his show.

I didn't know that.

In fact, there seems to be some taboo about even calling out comedians.

When Joe Rogan confronted comedians about Mencia stealing their shite, they were reluctant to admit it on camera (maybe they had stolen it too?) -

And Rogan said: See that's the problem, nobody calls these people out, we all just accept it.

I'm starting to feel that no one wants to accuse because they probably got their material from somebody else...circle of parity.

My personal fear would be stealing something without meaning to. No one can see what every comedian has said always. I imagine there are times where a comedian used near identical material without legitimately knowing that someone else had done it before.

On a semi-related note I remember hearing Alice Cooper once say that's why he won't listen to new / unknown band's music who send it in to him because there are only so many notes and chords you can play and if Cooper happens to put something out that sounds similar he'll be accused of stealing it.

That sounds normal and fair.

Just like I had said about the novel.

The old joke is, everyone is still stealing from Homer.

But I swear...it was just weird...the bits sounded so similar - it wasn't just the topic...but the punchline was the same...

Maybe it's like cycling, everyone cheats in comedy...that's how you stay relevant.

Maybe it is cycling and the reason Mencia got called out was because he was stealing from his contemporaries and his colleagues?

Those three comedians are all extremely well-respected. I don't think it is joke stealing at all, but an example of a concept called parallel thought. For example, when they were trying to build the border fence, dozens of comedians all had the same thought/joke that they would hire Mexicans to build the fence. Or after something big happens on twitter, literally thousands of people will make the same exact joke separately from each other.

Mencia, on the other hand, went to open-mics in Los Angeles and sat in the back with a notepad with the sole intention of stealing material. Other comedians would refuse to do their act if he was in the room.
