TS will pay for this monetarily via lost endorsement money because it does not pass the public's smell test. It looked like he was trying to intimidate him and 'accidentally' hit him. But the guy did run on to the track so I doubt he does any time.

Dude, you are probably the most consistently correct poster on here but you are wrong about this thread. YES, the retard walked onto the track but TS absolutely could have avoided this.

I think it was obvious that Stewart meant to "bump" him. I'm sure he never meant to cause severe injury.....BUT....he did.

Negligent homicide. 3 - 5 years prison.

ETA: 3 - 5 years sentence...probably gets suspended time with just probation. Still serious shite.

Ouch.

Not a chance.

There is some dumb on both sides tonight. I watched the video over and over and you can't for certain say TS meant to hit the kid or even scare him. You can't say for certain that was TS's car you heard rev up.

There is blame to go around for both. The kid should have never gone walking into the track, he went deep in. TS obviously should have slowed down and not been so high up. Did he try to "scare him"? It looks possible. But they will never convict him on this.

He's going to lose from a PR standpoint though.

ETA: I am not a racing fan and don't give a shite about TS. But my wife and I both watched the video and both were wondering why the kid went so far in. Either way, very sad for him and his family.

I predict new rules following cautions.

Yeah, I'm pretty certain (beyond a reasonable doubt) that it was Smoke's car that we heard and saw rev up.

I couldn't agree more...thus the negligent aspect of the charge against TS.

You and I agree on this point.

You and I disagree on this point.

Did he try to "scare him"?

Thus the negligent aspect of his crime. It is a real thing.....may not serve a single hour in prison, but still subject to conviction.

As I stated in my post....conviction with suspended sentence and probation.

Here's how I see it. Tony wrecks the kid, kid gets out and becomes angry, tony turns to avoid him and get away, but he hits the accelerator to intimidate him. He happened to do it while he was turning away causing the car to hit the kid. Tony is guilty of fricking up and shouldn't have accelerated... but he didn't hit the kid on purpose

Not objective at all I see.

That kid walked out in front of Tony's car. There is not enough evidence to say Tony tried to kill that dude.

2015 Rules:

1.1: Don't run the frick over anyone walking on the track regardless of their reason or purpose.

eta: YES, I was being a smart arse...sorry.

I see manslaughter at worst for Stewart. Gross negligence behind the wheel of a car.

Manslaughter is a more serious crime than negligent homicide. In fact, manslaughter carries up to 40 years time. Doesn't fit this situation in my opinion.

Play stupid games win stupid prizes. Getting out of your car in a black jumpsuit while it's relatively dark with cars that would seem to have limited visibility sprinting around didn't seem to be the best decision

Just saw the footage on espn. Nothing will come of this. He'll take some "personal" time off, lose a few sponsors.

ive seen this quote and several others from people who were there:

quote:

Update (12:29 a.m.): The Sporting News's Bob Pockrass has some more details:
Rich Willis, who was at the track, said he didn't see exactly what happened but his sister down in Turn 1 did. He saw Stewart and Kevin Ward get into the wreck.
"People (who could see it better) said the guy got out of his car and was gesturing angrily at Tony Stewart when Tony Stewart came by during the next lap under yellow," Willis said in a phone interview. "He approached him and evidently when he was driving by the guy standing on the track gesturing at him, he gunned his engine.
"What happened was the back end kicked out and clipped the guy and the guy flew across the track."

to me it looks like the back end of tony's car swerved away from kevin ward. opposite of what this guy said. looks like tony fishtailed after he had already hit the guy with the front wheel.

I couldn't agree more...EXCEPT for the fact that Stewart saw him long enough to "gun" it and fish tail into him.....accident and coincidence? I don't think so.....but would be MY defense!

That is not how I saw it at all....but that may be up to a GRAND Jury to decide...before charges will be brought.

I feel certain that the DA in that county will let a Grand Jury decide how far this goes.

Watching the video I don't see him getting charged with anything.

Kevin Ward's family will possibly get a cash settlement out of this.

Most horrific thing I've seen on a track since Tom Pryce.
