I do support the jock’s appeal of his suspension, though. If the horse ducked out from a left whip or something I’d get it. But that’s not what happened.

The Kentucky Horse Racing Commission is a state agency. Lots of state agencies are required to give you hearing rights. Usually another state agency (Office of Administrative Hearings) that hears administrative appeals will have an administrative law judge that presides.

So it may not be so frivolous.

And that's where the "unconstitutional" part comes in. They are claiming they were denied due process. It explains it in the OP like 2 sentences later.
