The Wests sued the Kentucky Horse Racing Commission, its members, staff and stewards who disqualified Maximum Security for interference. The federal lawsuit was filed in U.S. District Court in Frankfort, Kentucky, and seeks to have the decision reversed and the original finish order reinstated.

The lawsuit calls the disqualification process "bizarre and unconstitutional." The Wests also seek to have the Derby purse money redistributed to them, jockey Luis Saez and trainer John Servis. The winner's share was $1.86 million.

The lack of an appeals process denied them their due process rights, the owners claim. They filed a notice of intent to appeal with the racing commission on May 6, asking for a hearing by the full commission, but that was denied.

Didn't realize the derby was a court of law.

Bad press for the Derby will be good in the long run. No one wants results overturned by video review.

Don't care, payouts have already been made They won't overturn it because it would be a living hell to collect payouts and to give people their winnings if it's overturned

Good and hopefully they win.

That decision was a disgrace and nothing more than an attention seeking decision.

We're gonna have one hell of a doubleheader coming up...a rerun of the Derby followed by a replay of the final 2 minutes of the NFC Title Game.

I'd watch.

Discovery could be fun

I’ve heard lawyers say that.

Anyway, would be cool if they found anything indicating disdain for Maximum Security’s trainer or favoritism for Bill Mott.

At any low-level track in a race that means nothing the decision to DQ the horse is made without question.

That was a DQ 365 days a year in horse racing.

They took a horse down in the Breeders Cup Classic, which is worth 3X the amount of money than the derby.

And The wests are going to get a healthy heaping of karma. Sore losers will find karma to be a serious bitch.

I don’t think it’s unconstitutional to be disqualified from a race

I want to start a class action suit because the Derby fiasco resulted in me losing interest in the Preakness and Belmont.

Servis doesn’t really have a sparkling reputation in the industry

Seeek they really have turned a lot of people against them. They were once thought of very highly. Now...

Yeah this seems idiotic, and I'm assuming somewhere they signed a contract understanding and agreeing with the rules of the race. Normal people in everyday life I guess I can understand not having a grasp on legalese, but these are millionaires in a millionaires sport.

You tell me what’s worse for the derby? The results overturned by an existing rule? Or blue tarps pulled over two horses who have to be euthanized on the track?
