1. It probably would have been brought to light earlier in his career if it was football

For one, Hernandez wasn't a star. Just another tight end prospect.

Second, La'el Collins didn't get drafted just for police asking him questions about his dead girlfriend so you're wrong on everything you said. And Collins was a projected first round pick.

So what's he going to sue them for? Relaying public information? The crime doesn't have to be in Oregon for them to be able to report on it.

Not 100% sure, but I'm confident that what you quoted was not correct. The general public should not have been able to find out that he was a sex offender.


So the question is can he sue the Corvalis PD for releasing something to the public that I believe per part of his plea deal, should have remained private. Heimlich is certainly not the guy to root for, I get that, and I'm not rooting for him at all. But I don't think anyone has answered whether he could actually have any kind of case in this situation.

He's on a sex offender registry, whose entire purpose is to inform the general public of sex offenders.

Details of the incident and arrest may be more protected because he was a minor when it occurred, but not his offender status.

My understanding, which is admittedly not 100% because there has been some false info, is that he did have to register until age 21, which he just made. That's when the PD incorrectly sent out the failure to register stuff on him.

Regardless, Washington does not automatically classify juvenile arrest records and these were obtained legally and publically by the newspaper.

Not every jurisdiction has quick and easy internet searches available for sex offenders, which means one would have to contact the local police for a list if them. College students aren't going to do that.

Are you saying he didn't do it? Or that he was not on the registry? The Oregonian article refers to the registry many times. It's not something that's really in doubt.

They're not private in Washington, where the crime occurred. No one ever looked into it because they didn't have a reason, but once he missed the update in Oregon and it was public record, the newspaper found the original crime in Washington.

In other words, you could have found the original crime 2 years ago if you wanted to look for it.

The key to all of this is the timing, and we all know it. Collins got screwed because of the timing, and Mixon was drafted because of the time that passed between the video and the draft. Heimlich going undrafted this year is not a surprise, but when the publicity settles down, will he play for OSU or get drafted next year? That is the more interesting question IMO.
