I don't think that matters at all.

All you have to know is that the student athletes freely enter this agreement...and can freely exit the agreement any time they want to.

And, the scope of power the NCAA has only pertains to activities within the NCAA. In other words, if a kid sells his autograph, they hold no claim to the money...they only say he's not eligible to play in the NCAA.
