What's the status of the FTC proposal to ban all non-compete agreements?

Help me understand this process. Can the FTC even ban them? Do they have that authority? If not, what happens when they issue the "ban" - does it have to be approved by congress? I can't find much information that makes sense to me online -- it's quite possible I'm just ignorant on the FTC's authority on the topic, though. Seems to me like this would have to be something congress needs to approve or Biden would have to issue an executive order in order to make it "law" of the land.

Can someone explain this to me like I'm five, please?

It’s in the public comments phase and is not law. After comments phase (60 days) FTC can propose a final rule. Whatever rule is proposed is unlikely to stand for same reasons Supreme Court struck down OSHA vaccine mandate. If anything is passed, it is likely to be less sweeping than a total ban and will simply impose minimum salary thresholds or limit non competes to salaried workers, for example.
