Texas registered business (clothing, art) sales tax when selling online to Louisiana

LLC registered in Texas.
Items shipped from Texas.
Within Texas, obviously I collect and report Texas sales tax.

My understanding is when sales are out of state (Louisiana specifically), I don’t have to collect and report sales tax unless I meet Louisiana Nexus.


Is this correct?

What is Louisiana nexus $$ amount?
Texas I think is $500k

You should ask your accountant. Every state has different requirements and such. Some are "if x percent of your business is in that state OR a nexus amount". etc....way too much varation

Googling Louisiana nexus and sales tax produces this:

Not sure if that’s correct, but the same info is found in multiple hits from a Google search.

RSC (Remote Sellers Commission) website has helpful information for you. It’s about whether you qualify as a dealer for remote sellers. Generally, the threshold for filing is $100k in revenue sold or 200 separate transactions (the or is important here—it can be either).

So, is this on an honors system? Who's checking to see if you've made 100k revenue or 200 sold transactions in a different state?

You could get popped with an audit which could subject you to penalties and heavy interest for failure to file. But, you could also run the risk of not doing so and flying under the radar.
