No. It's just using a common feature of two things to make a comparison. I made the analogy that catching someone raping your daughter and inciting you to kill, is LIKE, not EQUAL to, someone calling you N***** (if you're black) and inciting you to throw a punch. Common feature of this analogy being a shocking event that drives someone to act in a way they would not normally.

What are you even talking about? I'm not equating the two acts. I'm comparing the idea of being driven to an action. Give me an intelligent breakdown of why the analogy does not work.

There are "fighting words," that imply your consent to rumble. Therefore there is no battery, which is contact without consent.

If you drop the n word on a black guy you will find many judges say you got the fight you were looking for. You have to remember if guys agree to fight that is not a crime. If someone issues you an invitation to fight you can refuse, but most of the time you agree and it is on. Opinions will vary. 10 lawyers will probably split 5-5 on this one.

Yep, that's exactly why I used that analogy. It's just what popped into my head and couldn't think of a better example. I've been awake for like 35 straight hours studying for finals lol

There seems to be a lot of confusion over the legal, versus the ethical issues here. That was also the case with fan reaction to Shadys.
I'll leave to others the ethical niceties of 2:00 am bar brawls after words intended to provoke violence. There are plenty here who seem to claim expertise on the acceptable punches to be thrown, when post pugilistic celebration becomes unseemly, etc.i don't know much about the etiquette of such things.
However, the legal issues are pretty clear.
This will never be more than a misdemeanor. If the alleged victim is unwilling to cooperate, the DA won't be able to successfully prosecute even if he wants to do so. And probation is likely to include new restrictions.
