I am not sure, but i think it is discretionary. In that instance, he would have been tossed for sure. It has to be unavoidable contact, I believe.

I like that rule if that's the case.
If the play is close then the runner needs to be able to take the plate but if you're hosed by a mile don't be a dick and get someone hurt.
