ESPN is not facing any fines or penalties for releasing info about JPP fwiw. Pretty sure it falls back on the person who leaks it.

ETA: Looked it up, HIPAA does not apply to news organizations.

Wrong...HIPAA does not apply to the general public passing on information that they heard or news media/law enforcement/etc. It is there to protect patient privacy and information used by healthcare workers/insurance/etc.

how, so if I go to the hospital and get diagnosed with cancer and a journalist is with me in the room he can leak it to CNN?

really? I really find it hard to believe that information that is kept so tight lipped that a journalist who overhears a conversation about a patients diagnosis could release this without consequence.

That would be a violation for the healthcare provider that allowed the journalist to hear the information, unless you gave permission for the journalist to receive the information.

so basically the criminal charge of HIPAA violation can only be applied to health care workers who have the clearance to protected information.

Yes. That's why you are not to discuss patients and/or their symptoms/diagnosis in public areas. So if a reporter overhead, it falls on the nurse/doctor for speaking in an area that they could hear.

yeah you def have to be careful, you can discuss it in public areas but you can't use anything that someone can personally identify who they are talking about. Even than you have to be careful.
