I posted this in the MSB but find it relevant here because it’s same topic and issue

I always considered undergraduate sports a sui generis entity and should be treated as such when it comes to the law, nothing like it in the world and nothing like it outside of schools, a uniquely American entity. Once tv and that NCAA v. University of Oklahoma SCOTUS case came into the picture the waters definitely got muddied and now college coaches are worth millions which would’ve been unthinkable back in the 50s/60s, it’s a big business unlike anything the NCAA creators during Teddy Roosevelt’s time could’ve ever foreseen. Luckily, the money from tv and exposure go to all the non-tv sports and education relative to the participating schools so it’s not implicating the Department of Education or RICO statute directly. The athletes are there to be students and they receive the benefits of being students and big-time athletes without having to pay or be taxed on what they receive, that’s why they receive full scholarships and attend an actual school, not a profession.

Is membership in the NCAA voluntary for colleges and universities?

If so, why can't the NCAA have rules that govern who is eligible and who isn't?

BTW, I am not against athletes getting paid. Just curious the actual legal standing the athletes have.
