In either of these cases would he not count as an initial counter? I would assume if the school doesn't submit the LOI he wouldn't count, but in the event he doesn't get accepted into school as a student, he would still count. Isn't this the part of the rules that were changed a few years ago?

I don't know for sure, but this is how I would rule it. No signee as the former and a signee in the latter. While I know what you meant by initial counter here, technically, he would never become a counter in either case because you don't become a counter until you actually receive aid. It's a subtle, but important distinction.
