IF she offered (this is the story from various students) him a blowjob and is now accusing him of forcing her to give him a blow job.. doesn't that change this entire situation dramatically? sure, he's still in trouble -- but he's not up to his neck in boiling oil

No it still fits in the statute. The sexual act occurred and it falls within the age limitations of the statute.
Knowledge of her age or consent does not matter. She could beg for it and it is still a crime if sexual contact occurred and it fits in the statute.
It will come down to whether the DA wants to prosecute.
But it seems to fit squarely in the statute.
This could effect sentencing but he could still be prosecuted and convicted under the statute.

I'm sure the tone of this thread would be drastically different, but the law still remains the same and he should not get preferential treatment.
It is still speculation at this point, but it doesn't look good.

Gotcha. That's where I hit the snag. Legally, she cannot consent.. and her not having the ability to legally consent forces this to be treated as if she was literally raped with force. Physically, mentally, and emotionally she can consent.. and this should (is normally?) be taken into consideration by the judge/whoever.
Is that a decent grasp? I hope the judge isn't a nitwit.
