Did you read the document? It does not say "after the bids leave" anywhere in it. It says what I quoted "after the birds arrive". No you can't injure or harass the bird while it's building, but you can destroy the nest when the bird is not in it, so long as it has no eggs or young.

Here is what the USFWS uses as a definition of "inactive nest":3 An inactive nest is one that is empty, contains non-viable eggs, or is being built but does not yet have an egg in the nest. LINK

I read the law and checked sources before doing anything with the nest. Once there are no birds or eggs in the nest, it’s considered inactive. It can then be pulled down.

There is a period after the birds fledge that they will return to the nest, but that period in between is still considered inactive.

So what I said, as long as there are no eggs or young in the nest it is inactive and can be removed.

But if OP is worried, call USFWS, they will probably give you a permit. They have always been helpful and laid back in my dealings with them. They told me to euthanize and dispose of a hawk once because they couldn't get out to the property that day.

I ended up balling aluminum foil up and hanging it with fishing string in the corners of the porch they like. So far so good this year.
