Question on Car accidents?

I backed into a car. Not much damage on said car however the person was parked illegally, the car was sticking out into my driveway. I understand that I hit the persons car and it is my fault. However the person wants to bring it to the dealership to get it fixed. I asked that they bring it to a auto body shop because it will be significantly cheaper. Does the work have to be done at the place of thier choosing or what? Also we both don’t want to go through insurance.

usually the insurance will decide from a list of approved places. if the dealership is one, they will send it there but it is unlikely as the insurance is not trying to pay that much.

you hit a parked car even if it is parked illegally and even if it is parked like a jackass you are at fault.

Even if insurance is involved, all insurance company can do is provide a list of recommended body shops and the vehicle owner has the option to use the shop insurance company recommends or they can bring it to a shop of their own choice.

If you're trying to avoid claiming through insurance, best you can do is ask the person to get at least 1 other estimate besides dealership to make sure dealership's price is fair. But honestly, you're at the mercy of the person you hit unless you let insurance handle it (which will cause your insurance to tag you with an at-fault accident and cause your rate to go up).

like to add they probably want a loaner from the dealer while the work is being done. easier to do through dealer.

Good point, because if it was through a different body shop then they would probably be asking OP to pay for them to get a rental car too.

Insurance companies can send you to a shop for an estimate, but can not dictate where you take the car for repairs.

Paying the shop to write their estimates is no different than paying an independent appraiser to write the estimates.

Absolutely because you hit a parked car.

And yes the person you hit will absolutely want a rental car, so factor that in if you want to pay out of pocket. Don’t forget diminished value, because the owner will surely claim the 1997 Honda Civic you hit will lose value because of the accident.

You shouldn't give legal advice if you don't know your arse from a revised statute.

I’m not a lawyer. But I hit a parked car or two. Could to know people can’t get shite out of me next time it happens.
