You can't charge someone without a victim. They can't prove he stole the van.

There is clearly a presumption that he took her vehicle without her consent being that she is missing and he drove home with her vehicle. At minimum, the cops could question how he ended up with her vehicle without her in it. If he refuses to speak then hit him with the charges because the evidence shows he took her vehicle and he hasn’t provided proof, even a statement/consent that she told him he could take her vehicle.
