Kavanaugh specifically states that the CDC "exceeded its existing statutory authority by issuing a nationwide eviction moratorium."
Then, in a truly spineless and unconstitutional turn, Kavanaugh legislated from the bench and allowed the CDC to continue the moratorium (even though he just said what they did was unconstitutional) because it was coming to an end very soon anyway and rental assistance could be distributed during that time (very little was).
The CDC then turned around and did nothing short of telling Kavanaugh to go F*CK HIMSELF because the biggest, most ignorant far, far leftwing whackjob constitutional hack masquerading as a "Constitutional scholar," Laurence Tribe, told them to

You realize that the opinion was 5-4.
Constitutionality just depends on the partisan lean of the court.
If there had been 2 more liberals on the court, I could easily turn around and say it's constitutonal.
Constitutionality seems to be a meaningless term if it just depends on the make-up of the court.
