The City of Birmingham is suing the owner of Valley Brook Apartments in an effort to reduce the amount of violent crime and other illegal activity that takes place at the complex.
quote:
Since February 7, 2021, officers have been called to the complex for six gun-related incidents, including two homicides.
The city looks to require the complex owners to install surveillance cameras and establish a full time security presence at the facility. If the owners aren't able to reduce the amount of illegal activity, the city wants the property to be sold.
quote:
According to Alabama code, ( 6-5-122, 11-47-117-118) municipalities can take steps against property owners in civil court to reduce or remove a public nuisance. The lawsuit claims that allowing the criminal activity to occur creates a public nuisance.

Dude is getting sued and likely can’t evict any of the criminals.

How is the owner responsible for this?

I've heard of cities taking over properties that were a "public nuisance". Kind of crazy.

I guarantee that apartment complex is Section 8. It’s a giant circle jerk of taxpayer dollars.

it really has - as to how the owner can be sued - turning a blind eye on a problem and not doing really anything to try and curb it, does fall on the owner.
