There's a difference between conduct and protected speech. You could also argue, although I don't think the law distinguishes, that a high school should have less say over a 14 year old's after school activities than a college. The college's reputation is tied to student behavior and the student is an adult. A child has parents who are there to regulate their behavior. It's a huge overstep from the school.
