Best and worst ever SCOTUS decisions

For me, worst is a toss up between Kelo v New London and FEC v Citizens United.
Best is definitely DC v Heller.
Best is definitely DC v Heller.

The worst was Buck vs. Bell, where the liberal majority of the court upheld the forced sterilization of a Virginia woman to prevent the birth of undesirables. The only dissent was by conservative Pierce Butler, a fundamentalist Christian. Liberals gush over Oliver Wendell Holmes, Jr., who ended the decision with the line "three generations of imbeciles is enough."

Good call, but the fact it was 5-4 should scare the living daylights out of every American, and make you thank the lord Trump is doing work.

Dred Scott
Plessy v Ferguson
Buck v Bell
Wickard v Filburn
Minersville School District v. Gobitis
Bradwell v Illinois
Korematsu v US
all say "Hold my beer".

We live in an administrative state with no accountability because of Wickard v. Filburn. It isn't a personal liberty case, but it is why the federal government touches everything from schools and housing to flood plains etc.

Does that include the Clintons??

Oh, oh, oh I forgot. The worst decision from the Supreme Court is actually Atwater v. City of Lago Vista.
Just in terms of how stupid and unjust it was. If you want to be incredibly pissed, check that one out.

I’m glad to see Wickard v Filburn mentioned. We have some good people around here if people know about this one.

Actually, as bad as that decision was, Dred Scott was worse. It contributed significantly to the start of the Civil War.

worst ever SCOTUS decisions.,,
Buck vs Bell (1929). Hard to believe (I thought it was a Nazi war crime) but our court ruled intellectually incompetent people could be sterilized. Over 70,000 were. I admired Oliver Wendell Holmes but this was a stain.
Roe vs. Wade (1973) Bad, Bad, legal decision.

Only possible because of Griswold. We've been enjoying those penumbras ever since.

quote:Dred Scott was based on existing constitutional recognition of slavery. The only way the Dred Scott decision could have gone the other way was to declare the slavery part of the constitution unconstitutional.

Plessy created blacks as legally second class citizens. Jim Crow could have been avoided if not for Plessy.

The best was the one involving the Westboro Baptist Church, not because they won 8-0, but because it confirmed that you do not have a right to be free from being offended.

That's a good list. I'd also add Bowers v. Hardwick, which is insane to think was decided in 1986.
