That is not the criteria. The criteria is - do Blacks think the phrase has a negative connotation to their race. Which they do.

In 2019, Robstown, TX (pop. 11,261) was comprised of 93.8% Hispanics, 5.8% whites, and 0% blacks.

Why should it not matter what the residents and taxpayers of the community want?
