I'm really surprised that the appeals court ruled this way.

If she filed her federal returns, and filed the state returns on the years around these two, then it's real weird that she would not file those two.

Also, they could call any CPA in the state as an expert witness, and hear about how LDR loses returns and misapplies payments, or loses payments, all the time.
