Wanting to reduce (or avoid) tax liability based on actual expenses is not a crime - it’s practically a national past time.

However, purposefully inflating expenses to do so would fall under the “evasion” category - that’s clearly a crime.

Think the problem for him is that he’s owed taxes and had federal tax liens filed against him for multiple years. Read an article that from like 2001-2010 every year he didn’t pay his taxes in a timely manner. Then when he submitted returns for the years in question he had very very little tax liability. So I think he was already under the microscope.
