This likely would have been the reason to not prosecute in the first place. They just dont do DNA testing for relatively minor things like this, unless of course it were evidence of some larger crime. Possession of the constructive sort would be nearly impossible to prove given the fact it's a rental that presumably numerous people have been in and had access to.
