I think you need to sue the State for damages. The State makes citizens buy a license to hunt and kill deer; so they seem to believe that they have some sort of ownership or custodial duty to the deer. As such, IMHO they have taken responsibility of the deer and should be held accountable for any and all damages incurred by the deer.

If you hit the deer out of season or did not have a big game hunting license they may come back on your for killing the deer out of season or without a proper license.
