And, where it is illegal the legal consequence is a traffic ticket and nominal fine - not a $10k life altering misdemeanor.

If they wanted to make the lower threshold the legal equivalent of a traffic ticket I'd be more in support of it, but they won't because that gets in the way of the cash grab.

I'm almost convinced that the reason they don't criminalize extreme DWI that much more heavily than low-level DWI is they want only want to offer token discouragement to the low life running over people with a 0.23% that generates the support for the lower-level cash grab DWI's in what is now looking like the 0.05% range.

I have yet to see the blood-eyed slumped over mug shot and stumbling police video of someone who killed an innocent victim with the headline "Local man kills mother of 4 in drunk driving accident, blew a 0.06% on the breathalyzer"
