It's gonna come down to what Cohen, Pecker, Pecker's deputy, and Weisselberg say about what the president knew and what they believe his intent to have been.

Wouldn't there need to be an FEC charge of campaign finance violations first?

It’s gonna be hard to prove intent. All I have to do is say, “is it possible Mr Cohen that Mr Trump didn’t want his wife to find out? Could it be Mr Cohen that Mr Trump wanted to save his marriage and spare his family from public humiliation. Is it possible Mr Trump never brought up his family because of the incredibly tenuous situation he found himself in. Wouldn’t you agree Mr Cohen that Mr Trump could be especially embarrassed because of the nature of Mrs Daniels work”?
