the abortion issue shouldn't be top priority

One of the lasting effects of slavery in the US is the absolute mangling of the Constitution by the Supreme Court through the years.

Roe v. Wade is based on the Due Process Cause of the 14th Amendment, which reads "[N]or shall any State deprive any person of life, liberty, or property, without due process of law .." as an amplification of the 5th Amendment which was only applicable to the Federal government. This Amendment was an attempt to prevent Southern states from discriminating against the former slaves. Roe v. Wade argues (and at 7-2 at that) this extends somehow to include a right to an abortion?

The Civil Rights act of 1964 is based on the Commerce Cause (intended to prevent states from starting trade wars with each other, and because someone has to have jurisdiction on trade matters when multiple states are involved). So, the Civil Rights act is deemed Constitutional because ..... people who travel between different states often eat at restaurants? (this is literally how it is argued).

This precedent of using the Commerce Clause to do whatever the Fed wants ends up with the Constitution further being mangled in 2005 when the Supreme Court ruled that growing marijuana for personal use was also subject to the interstate Commerce Clause - because (get this), "It can interfere with national marijuana market".
