Messages showed as "read", and he didn't delete. I'm not sure if he'd be held responsible for not reporting the content (ala Urb), but if it's on his phone and still visible, he's in posession of child porn.

Probably the same way you would get a possession charge if somebody left a baggie of cocaine in your car.
If somebody sends me something resemble child porn it’s getting deleted and that number blocked with quickness.
