Texas law has improved markedly in the last 30 years or so, as far as the man’s rights.

I'll say - My granddaughter divorced an abusive husband about five years ago - when he stared abusing the two kids and the dog in his rants. He has yet to pay a dime of child support or health insurance for the kids. He only pays when his paycheck is has court imposed deductions - then he quits that job and gets another one until that catch up with him again.

However he still has full visitation rights, even though his only interest in the kids is to take them from their mom - he does nothing with them when he has them - just puts them in a room with video games or leaves them with his mother. The kids have seen him abusing his current live-in and her kids and are sometimes scared to go with him. My daughter and son-in-law (their child) have spent a fortune on lawyer's fees trying to get him to pay his obligations - he always gets a court appointed attorney whose only function seems to be to delay hearings so that it runs up her lawyers' fees.

He has been stopped with two DUI's but still gets to take the kids - we finally got the court to require an alternate driver to be on hand when he picks up the kids.

It is a continuing shite-show.

First I’m sorry for the kids and dog. They had and have no say in this situation. I have sympathy for your granddaughter; she is suffering the consequences of a very poor decision. She chose to marry and reproduce with a man who is: abusive, financially irresponsible, negligent, vindictive, and a drunk. Surely he didn’t fall and hit his head on the honeymoon and suddenly experience a personality change?

Obviously he is behind on child support. Has she tried to get sole custody until he brings the debt current? Also, when the children become young teens they can petition the court to end his visitation rights. Finally, we both know that this dumb arse (2 DWIs) doesn’t care about the law and will not honor the court ruling of an alternative driver. Hire a PI or have friends and family stake him out and video him driving the kids around. The important thing is protecting the kids. Also, teach them good decision making so that they do not make the same error of their mother.
