2 men sentenced to probation for gang-rape of 13-year-old girl, triggering backlash

He protested the plea bargain, angrily stating the men should do time.

The crime happened in late 2016 at the Stonebrook Terrance Apartments on the 4000 block of Tappan Drive. The child reported the crime to police six days before Christmas that year. She told investigators she knew one of the suspects, who invited her to the apartment to play video games.

On the bright side, the chances that these guys don't almost immediately violate their probation is zero.

Still total bullshite, though.

Agreed. What a sick judge though. This poor little girl will be tormented for eternity while these scumbags are out doing whatever.

Very sad and I hope she can somehow come to grips with the slap in the face.

If they mattered so much, then why dont they ever do anything with them besides aspire to be athletes and rappers..but settle for gang members when that doesnt work out?

This case has been discussed here when the first two got probation.

It's not as clear cut as you're making it out to be, fwiw.

ETA - Found the article that provided updates (The one in the OP is 4 months old). There was video of the incident and the judge dropped the forcible rape charges as a result. The adults in the case are looking at statutory rape, not forcible rape. The video was on a cell phone that was locked and just recently found.

ETA.2 - For clarity:

The police have has that phone in their custody but it's encrypted and it has passwords on it. And it's an iPhone and as you know [Apple] is not being cooperative with law enforcement across the country," said District Attorney Dan May.

New technology called Gray Key allows the police department to get into the locked phone with a judge's warrant.

"We're trying to do that balance where we protect people's rights as well as do our best to our victims, so in this case, it took a little while for technology to catch up," said Colorado Springs Police Chief Pete Carey.

In the last 10 days, police were able to access a cell phone video that seems to contradict some of her claims.

"Justice doesn't always mean making a prosecution, or a good conviction," said Carey.

The video records the girl's voice as she "appears to be laughing and giggling and engaging in consensual sexual acts."

"Potentially withholding this information could be exculpatory - and help out this particular defendant - but may be inculpatory for others," said DA May.

In court, the judge dismissed the teen's case following the new evidence.

"When we were able to get into to some of the messages and the video and things like that, it worked out very well. By worked out very well I mean justice was served; so this is a good thing," said Carey.

Looking forward to Malcolm Jenkins paying for a full ride to college for this young gal. I'm sure he already has his people on it.

No of course not, and I'm not trying to defend the incident, just pointing out there were some inconsistencies.

4 of the 6 took plea deals, the oldest went to court and was ultimately convicted, and one is still awaiting trial.
