Is it just the pictures, or is the elevation of the trees below the elevation of the spillway? Looks like theres a chance they may be in the water? Does your contractor have any way to shoot some grades for you?

They're below. That's why he was hesitant to build the spillway up. I said to just remove the trees, but he thinks when it's at full pool after a big rain the closest tree will bee in 6"-1' of water. When it levels off most of the year, the water should be about 1' shy of the top of the spillway and ride that lip on the point off the tree.
