Basically, he never tampered the sample. The tester said he saw him "attempt". But since he technically never turned in a false sample, he didn't do it. The basis is only on what someone saw. So now the Fulton lawyer is basically saying "prove it".

They are arguing he falls under Section 3.3 which claims a violation if a tester
fails to provide a urine specimen according to protocol; (this is why they are arguing the collection process, he gave a sample it just didn’t follow normal procedure)
If the NCAA agrees with this then it is viewed as a positive test result and carries a one year suspension which he will have already served.
In my opinion this can be a win-win for the NCAA and Fulton. The NCAA doesn’t need to cave into demands just acknowledge there is a different violation that could be assigned to him. Fulton is still considered guilty and has served punishment and still sees the field a year early.

Well, I got absolutely roasted on this board for stating that he never actually tampered and that he just planned to do it, but backed out.
I should get a damn medal for calling this shite if it actually plays out like that.
