It would be non-standard. I know, it isn't admissible in court (what does THAT tell you?). But, if the ATTORNEY wants to proffer this as 'proof' in the court of public opinion...then, do it following the proper procedure.
If a truly admissible piece of evidence were obtained against his client (for an actual court case) in a way that failed to meet the protocol (even if it "works") do you disagree that he would fight it and win its exclusion?

well the entire test is bullshite in the first place. Since I failed 2 counterintelligence ones. 
I don't know what their "official" protocol is, just my experiences and I had them do it on the forearm at least once.
