Pedestrian can do things that make it impossible for a vehicle not to hit them. so yea, it matters, in part, if they were in a cross walk.

how many people would you say use the crosswalks in a 1 hour period during the day in a busy city?

i dont know what city you live in but this happens constantly in nashville.

i'm not going to go into the demographics of who is more prone to jaywalk but suffice it to say this happens enough that i cant imagine an autonomous car being injected into the mix without catastrophic results.
