Completely irrelevant. All that matters is what the police officers thought they were walking into. As far as we can tell, they were called to a hotel where a "gun" was being pointed out a window. That's all they knew. What they learned after the fact is not relevant.

But again, that cop should be in prison. They had ample opportunity to secure this 'suspect' or even just let him lay on his stomach - instead he amplified the situation and a drunk guy reach to keep his arse from showing, and got murdered. Terrible situation...both parties contributed to the outcome but it did not nearly approach "take down" scenario.
