So even though there is someone in front of him, he should get over behind the 18 wheeler and have to slam on his brakes because you are tailgating him?

Someone was trying to pass him, and he obviously had room to get over. His fault he got passed.
No doubt he would've just sat behind the car in front of him until they got over. I can assume that, because it happens 99% of the time. He's just one less car for the "a-hole" to pass
