They're advertising the nominal size, that it's cut to green at the mill. It shrinks to a set measurement when dries. They're not just making it up as they go along and anything close to 4" will fly, it's very consistent, and is listed as such on the actual dimensions of the product. This lawsuit is going to be thrown out pretty quickly.

Haven't been to HD lately, but I know Lowes has the actual sizes printed on the price card on the lumber rack.

Maybe we should sue everyone who ever built anything ever because it could be up to 1/16" off from nominal dimensions listed
