but now the reason for an innocent person to settle is gone. so if someone is extorting you...fight it. if you have something to hide...settle

There is a calculation involved in every settlement, and I would trust fox's lawyers to know how to figure it out.
Bill oreilly doesn't change any of these calculations IMHO.
