That is not a good analogy. Fires are a danger to everyone in the vicinity. A fire is a public safety issue.

I had a patient who burned down his own home "to get rid of the demons." He was charged with arson. He always asked me "how in the frick can I get charged with a felony for destroying my own shite?" Interesting...

The issue in question is playground safety. I'm not sure what the legally correct ruling is but if that's your argument, the provision in question should be voided and the ruling limited to safety measures, with the Court remaining silent on other types of public funding.
