Switzerland: French man convicted of rape for taking condom off

I actually don't have a problem with this although I believe it should be a different crime than rape. Something like "contraception fraud." It should also apply to women lying about being on birth control.

What he did was wrong, and there's no reason what he did should be OK. But rape?

If it can be proven that the man put on the condom and took it off without her knowledge, I'm fine with charging him with rape.

But, how was this proven in court?

That's where I am with it. It's a sleazeball move that can medical repercussions beyond pregnancy, but it's not rape.

Sounds like you don't even need to have one on and take it off, just not have worn one when it was "expected"

The main issue is how do you even prove it? Seems like the guy claiming it came off accidentally is enough for reasonable doubt. I have no clue how the French legal system works, though.
