Not necessarily. They can record whether the TV is on OR off, well actually that isn't quite true, because the TV isn't actually off, the owner just believes it is.

The TV show/movie audio would also obfuscate listening somewhat. At the level they'd be hacking a TV though they would already have a baseline audio file to help root out and differentiate the "suspect" from the audio of the program viewed probably.
How to outsmart a smart TV? Unplug it or flip the on/off switch on the power strip/UBS/etc.. No power = dumb TV.
