A professor in a classroom should not be expecting the lecture to be considered private.

Section (c) of the California Penal Code appears to agree with you:

[i](c) The term “confidential communication” includes any communication carried on in circumstances as may reasonably indicate that any party to the communication desires it to be confined to the parties thereto, but excludes a communication made in a public gathering or in any legislative, judicial, executive or administrative proceeding open to the public, or in any other circumstance in which the parties to the communication may reasonably expect that the communication may be overheard or recorded. - See more at: LINK ]

This will all come down to a lecture either being given the status of confidential communication or not. Good luck with that OCC.

Why exactly? You don't get to take a class unless you have paid your tuition and are registered to it.

You can't just walk around a campus and randomly show up to whatever the hell you want.

This isn't some free seminar held at the local Y.
