Why is this a burden? Is the Executive Branch not allowed to determine what is a threat and what is not? How is the judicial branch qualified to determine security threats?
Instead they got lazy and relied on "Obama and Congress named these states!" The problem is that those actions in 2015 only paused visa-free travel from these countries. Trump's order goes farther by disallowing all travel, visa or no visa. So that doesn't get you where you need to go once you get to the appellate level.
