i don't buy the whole will smith makes swings and misses theory, how the hell does will smith make an honest swing at hayes and miss...

It isn't irrelevant. If it is established that Will Smith was the aggressor that goes a long way towards suggesting that the guy may have had to defend himself. This is pretty plain and simple, and would be clear as day if the alleged aggressor wasn't a former New Orleans Saint.
