That's only if Mattis can explain this situation as well as you did and make it in a politically dumbed down manner where democrats can't make hay of it.

Confirmation may be 51 votes but the waiver itself will have to be separate legislation and that needs 60 votes, so that's about 8 democrat votes. I can see Manchin, Coons, and 5 democrats up for rebellion in ruby red states going for the waiver. He's going to need one or two more.

Mattis is smart and intimidating. I think he will be fine.

He will get 60 if it gets to that. The democrats will lose mucho patriot points if they frick with this selection.

Or...the statute can be challenged on the basis it is an unconstitutional limitation on the President's appointment powers.
