This was discussed like the day that trailer came out. Everyone knows that filming actual footage off screen would look like arse so it is digitally added later.
That said, Nintendo would be incredibly stupid to show footage of games on their console without having something solid to lead them to believe that it will be a reality. Bethesda basically saying "no comment" means nothing.

Eh, If anything is misleading it's the title. This is just marketing 101.
Everyone does this stuff, and people don't make comments because they always feel it will impact sales.
"Xbox will be your media center"
"Rise of the Tomb Raider will be exclusive"
Even Nintendo will say this won't replace the 3DS or the Wii U it's another third pillar!!

That Mario footage is obviously a scrapped together demo but I think it was a deliberate choice. Mario switch is in development and is coming sooner rather than later

The question should be: Is Bethesda working on TES 6? If so it would probably come out in 2017-2018 right? Maybe they are just getting people pumped for the next Elder Scrolls game and partnering with Nintendo showing that TES will be on the Switch, not necessarily Skyrim. That would be acceptable I would think.

Nintendo hasn't mislead anyone any more than other major game developers or the fast food industry. I'm not saying I'm a fan of the practice but it's the reality of advertising.
And while we can probably assume there isn't a version of Skyrim at present that will run on the Switch, we can be fairly certain a build of Zelda: Breath of the Wild can run on it. Were we seeing actual footage of it in the Switch ad? Of course not but that's the case when you see any screen shown in any ad.
